Terms of Service
1. The service
EU Compliance Kit is a Shopify app that helps merchants display EU-required storefront information (harmonised guarantee labels, product safety information, and a withdrawal function). By installing or using the app you agree to these Terms and the Data Processing Addendum below.
2. Not legal advice
The app is a display and workflow tool. It does not provide legal advice, and using it does not guarantee compliance with any law. You are responsible for the accuracy of the information you configure and for your own legal obligations.
3. Fees
Paid plans are billed through Shopify's app billing at the prices shown on our App Store listing. Trials, upgrades, downgrades, and refunds are handled through Shopify.
4. Acceptable use
You may not resell the app, interfere with its operation, or use it to display information you know to be false.
5. Warranty disclaimer and liability
The app is provided "as is" without warranties of any kind. To the maximum extent permitted by law, TuxPaw's total liability arising from the app is limited to the fees you paid us in the twelve months before the claim. TuxPaw is not liable for indirect or consequential damages, or for fines or penalties arising from your own compliance obligations.
6. Termination
You may stop using the app at any time by uninstalling it. Data handling on uninstall is described in the Privacy Policy.
7. General
These Terms are governed by the laws of the State of Florida, USA. We may update these Terms; material changes will be announced in the app.
Data Processing Addendum
- Roles. The merchant is the controller of shopper personal data; TuxPaw is the processor.
- Scope. Processing is limited to the shopper's name, email, and order reference submitted through the withdrawal form, for the purposes stated in the Privacy Policy.
- Instructions. TuxPaw processes personal data only to provide the app's documented functions and on the merchant's documented instructions.
- Confidentiality and security. TuxPaw applies the technical and organisational measures described in the Privacy Policy: encryption in transit and at rest, access limitation, access logging, and encrypted backups.
- Subprocessors. The merchant authorises the subprocessors listed in the Privacy Policy. TuxPaw will give notice before adding subprocessors.
- Data subject rights and deletion. TuxPaw supports the merchant via Shopify's privacy webhooks (data request, customer redaction, shop redaction) and deletes or anonymises personal data accordingly.
- Breach notification. TuxPaw will notify the merchant without undue delay after becoming aware of a personal data breach affecting the merchant's data.
- Transfers. Where personal data is transferred outside the EEA, TuxPaw relies on its subprocessors' data processing agreements incorporating EU Standard Contractual Clauses.
